By accessing or using Cash and Caddy mobile application ("App") and services provided by GolfPodz Technologies Inc. ("Company", "we", "us", or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.
Cash and Caddy is developed and operated by GolfPodz Technologies Inc., a company dedicated to enhancing the golf experience through innovative technology solutions. Our mission is to provide golfers with tools that make betting, equipment tracking, and game management seamless and enjoyable.
Cash and Caddy is a zero-liability wager calculator and equipment longevity tracker for golfers. The App provides:
Important: The App is a calculation and tracking tool only. GolfPodz Technologies Inc. does not facilitate, process, or guarantee any actual monetary transactions or wagers between users. All betting and financial transactions are solely between users, and the Company assumes no liability for any disputes, losses, or issues arising from such transactions.

The App offers free and premium subscription tiers:
Subscriptions are managed through the Apple App Store or Google Play Store. Payment will be charged to your account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage subscriptions in your device's account settings.
Billing and renewals: Your subscription renews automatically unless you turn off auto-renewal at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Refunds: Subscription purchases and refunds are handled by Apple or Google under their policies. We do not directly process refunds for App Store / Google Play purchases.

The App, including all content, features, functionality, and design, is owned by GolfPodz Technologies Inc. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described in the Privacy Policy. We use Firebase for authentication and data storage, and RevenueCat for subscription management.
The App integrates with third-party services including:
Your use of these third-party services is subject to their respective terms and conditions. GolfPodz Technologies Inc. is not responsible for the availability, accuracy, or practices of these third-party services.
You are responsible for complying with all applicable laws where you live and where you use the App. The App is intended for users who are at least 13 years old. If you are under the legal age to participate in any wagering-related activity in your jurisdiction, you must not use the App for wagering-related purposes.
Cash and Caddy is a calculator and tracker. The App does not run a sportsbook, does not take bets, does not pay winnings, and does not hold user funds. Any wagers or payments are strictly between users and are not facilitated by GolfPodz Technologies Inc.
GolfPodz Technologies Inc. is developing automated golf simulator pods to be placed in high-traffic locations. These pods will allow users to book time slots and practice in immersive environments. When available, separate terms and conditions will apply to simulator pod bookings and usage. The App may integrate with simulator pod services in the future.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. GOLFPODZ TECHNOLOGIES INC. DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLFPODZ TECHNOLOGIES INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.
You agree to indemnify and hold harmless GolfPodz Technologies Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any rights of another.
We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.
GolfPodz Technologies Inc. reserves the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GolfPodz Technologies Inc. is incorporated, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and GolfPodz Technologies Inc. regarding the App and supersede all prior agreements and understandings.
